Acceptance of Terms

By accessing this Website www.bookapartmentcroatia.com  ( “BAC”) and/or using our Service whether or not become a register User (“You”), You are agreeing to comply with and be bound by following Terms and conditions of use (“Terms”), which You acknowledge to have read and understood them in entirety, which together with Our privacy policy govern Aurora Novus's relationship with You in relation to this Website. If you disagree with any part of these Terms and conditions, please do not use the Website.

 „WE“, “US”  (www.bookapartmentcroatia.com owned  and operated by Aurora Novus d.o.o) reserve the right at our sole discretion, to change ,revise, modify or alter these Terms and conditions at any time, by posting the revised Terms and Conditions on this Website.  By using this Website You agree that the posting of new, or revised, or changed Terms on the Site shall constitute adequate notice to You of any and all revisions and changes.  Users must therefore review these Terms on a regular basis to keep apprised of any changes.   Any use of the Site (continued use of the service or upon logging into the Site) after such posting shall be deemed to constitute acceptance of the revised, new Terms by the User.

Your Account

If you use this website as a registered User, You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.  You agree to use My Account for your personal use only, and not to redistribute any of the content on this Website. If you are under 18, you may use our website only with involvement of a parent or guardian.  „WE“ may add, delete or change some or all of the Service provided for free as part of My Account at any time.“WE “reserve the right to refuse service, terminate accounts, remove or edit content, change headings or cancel bookings in our sole discretion.  Any use of My Account to post false, misleading information, or to post information that in our sole discretion is inappropriate to our Users are grounds for immediate termination of My Account.

As registered User, You further agree to update Your details (personal info) if needed, as defined in the Privacy Policy. You allow „US“ to contact you on your e-mail address with personal communications related to your account,  booking,  booking confirmation,  updates and anything else that may regards  the booking process. „WE“expect all of our Users to conduct themselves in a courteous, professional manner at all times.

License and site access

BAC/ Aurora Novus d.o.o. grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of” US”. This license does not include any resale or commercial use of this site or its contents: any collection and use of any listings, descriptions, or prices, downloading or copying of account information for the benefit of another merchant, or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without express written consent of Aurora Novus d.o.o.

Reviews, comments

Only Renters with realized bookings are permitted to post reviews, comments , so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable that does not consist of or contain software, viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “SPAM”. WE reserves the right to remove or edit such content .If you do post content or submit material, and unless we indicate otherwise, you grant “US” fully sub licensable right to use, reproduce, publish, translate, distribute, and display such content throughout the world in any media. You also grant US and sub licensees the right to use the name that you submit in connection with such content. You represent and warrant that use of the content you supply does not violate this policy and that you will not indemnify US for all claims resulting from content you supply. WE have the right but not the obligation to monitor and edit or remove any activity or content. We take no responsibility and assume no liability for any content posted by you or any third party.

Listing content and owner’s obligations

Listing your holiday rental (HR) with “ US” is free of charge. You can make your own listing (advert) in Croatian and English language, just in 6 easy steps if you register as Owner on www.bookapartmentcroatia.com  using our free tools “List your holiday rental” or “Add a holiday rental” and you can set as many HR as you wish, and all of them can be managed whenever you want through “My holiday rentals” in My account.

Owners or his/her representative who would like to list their holiday rentals on our website  www.bookapartmentcroatia.com  are obligated to send “US” by e-mail or fax, or via post copy of Rental license (Rješenje o kategorizaciji)  issued by Croatian Tourist Authority , for each holiday rental and are fully morally  and criminally responsible for accuracy of  the document. All listings without Rental license cannot be active online.

All listings to be active online must meet categorization criteria upon Croatian low of categorization + our own criteria what shows quality of private accommodation. WE reserve the right at our sole discretion not to activate listing for any reason.

Owners or his/her representatives are obligated by these Terms & Conditions  to list holiday rentals truthfully, fairly and accurately, and to keep their availability calendars up to date and accept all confirmed reservations made through our website.

Owners or his/her representative are not allowed to set any web page or links to content of the listing, and the same will be removed by BAC administrator.

WAY OF BOOKING

To enable our Renters (Guests) to book holiday rentals with real time availability calendars, on our website www.bookapartmentcroatia.com  all holiday rentals can be booked online in one of two different ways. There are:

Either INSTANT ONLINE BOOKING or PRE-AUTHORIZATION ONLINE BOOKING within 36h (Pending Reservation)

Instant online booking means that You as a registered Renter are able to instantly book your chosen accommodation online, paying  the reservation deposit by your credit card through T-com Pay Way  (our service provider for secure online payment), and within few seconds of completing your reservation and paying the  deposit, you will be able to print  Confirmation of your reservation, and you will also  receive 2 automated e-mails. The first will be the receipt of payment from T-com Pay way, and the second will be a confirmation e-mail from US with all details of your reservation: deposit paid, balance due in cash, owner’s contact details, address etc.

Pre-authorization online booking within 36h (Pending Reservation) means that you as a registered Renter are able to book your chosen accommodation and to receive confirmation within 36h, only after Owner's acceptance.
Your credit card will be pre-authorized in the amount of the reservation deposit through T-com Pay Way (our service provider for secure online payment) and your chosen accommodation cannot be bookable (within 36h) for the same period by any other Renter through our website. The Owner of your chosen accommodation will be informed by email of your pre-authorized booking and will be asked to ACCEPT OR DENY your PENDING RESERVATION. If a PENDING RESERVATION is accepted by the Owner your credit card will be charged for the reservation deposit and within few seconds you will receive 2 automated e-mails. The first will be a receipt of payment from T-com Pay way, and the second will be a confirmation email from US with all details of your reservation: deposit paid, balance due in cash, owner’s contact details, address etc. Logging into My account you will be able to print Confirmation of your reservationIf a PENDING RESERVATION is denied or not accepted within 36 h, your reservation is considered CANCELLED and you will be noticed by email that your credit card has not been charged and reservation is cancelled.

Private Accommodations with Instant online booking are not instantly bookable in the case that your booking date is less than  3 days prior to arrival, but you will be able to make Pre-authorization online booking with 36h for your chosen accommodation.

DETERMINATION OF WAY OF BOOKING

Only Owners or his/her representatives who regularly keep availability calendars updated can have Instant online booking  for their holiday rentals listed on our website. We do our best to have this majority, but sometimes it happens that private owners in some periods are not regularly up to date with their availability calendars or do not prefer instant booking.

To avoid any inconvenience BAC allows potential Renters to book these holiday rentals only by pre-authorization online booking within 36h - Pending Reservation

Due to these reasons “WE” reserve the right to determinate the way of booking for each holiday rental listed on our website, and that does not exclude the right of the holiday rental owner to declare in writing which way of booking they prefer.

Importance of Confirmation

Once your reservation is confirmed, you should print   the “Confirmation of your reservation”.

“Confirmation of your reservation” is official document of your confirmed reservation and you must bring it with you and present to the Owner or his/her representative upon arrival, together with your travel documents. If you do not receive that email you can log into My account and print it. Due to any reason you are not able to print it, please contact us as soon as possible and WE will resend it to you.

Payment

Prices on our website www.bookapartmentcroatia.com   are quoted in Euros per accommodation per night.

At the time of booking, in order to confirm your reservation you are required to pay a non-refundable deposit online by your credit card, which is 20% of the total price of booking.

 „We“ accept one of the following credit and/or debit cards: American Express®,  MasterCard®, Maestro®, Visa®,  Diners®  through the T-Com Pay Way service.

     


The balance payment (city tax and VAT included) must be paid directly to the property owner in cash (either Euro or Kuna) upon arrival. If you, due to any reason would like to pay the remaining balance payment via bank transfer or by another option of payment you must ask the owner in advance if he/she is willing to accept that payment option.

In some cases a security deposit is requested by the Owner (indicated in Rates and Confirmation of your reservation) and should be paid also in cash upon arrival at the accommodation unit. The security deposit is a guarantee for the service provider - Owner (or his/her representative) that the Renter (Guest) will not cause any damage to the accommodation unit or its contents. On the day of the Renter’s (Guest’s) departure, the entire amount of the security deposit will be refund by the Owner if the accommodation unit and its appliances are left in the same condition as were found upon arrival, without any kind of damage.

You understand and agree that “www.bookapartmentcroatia.com”“ is a Website venue owned by Aurora Novus  d.o.o. which enables  registered Users  You (Renters) and other Users (Owners) to conclude rental transactions among. Registered Owners are able to offer for rent a specific holiday rental to potential Renters. We do not own nor can We contract for any holiday rental listed on the Site. BAC/ Aurora Novus d.o.o. is not a party to any rental transaction. WE are not involved in the actual transaction between Renters and Owners who are solely and entirely responsible for their performance.

In the case that you would like to make a reservation but would not like to pay deposit by your credit card, please contact us.

Conversion Statement

“BAC”/Aurora Novus d.o.o. will charge your credit card for the reservation deposit at the time of your reservation confirmation and will be effected in Croatian currency Croatian Kuna (Kn). The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian kuna according to the current exchange rate of the Croatian National bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated on our website.

Price Adjustment

The rates of each holiday rental listed on our website reflect the prevailing prices at a given point in time. By making a booking on our website you lock in the prevailing price. Holiday rental's owner from time to time could change rates to reflect improvements of booking which can indicate in raised or discounted rates.  In these cases, no price adjustments will be made to bookings that were made prior to the implementation of the rate change.

Complaints

BAC/Aurora Novus d.o.o. must be aware of any and all complaints in writing. Following any complaint from a Renter We reserve the right to investigate and will try to rectify the problem to his/he satisfaction and to take reasonable steps.

Cancellation

Cancellations must be communicated with US in writing by e-mail.

The reservation deposit is non refundable for cancellations requested by the Renter (Guest).

Any full or partial cancellation of the reservation prior to arrival will result in the loss of the reservation deposit paid for the cancelled nights. In case of partial cancellation, when you would like to shorter your stay, the reservation deposit paid at time of your booking can not be applied to the balance payment you due to pay to the Owner for nights stayed.  If you would like to make partial or full cancellation after your arrival at the property, no refunds of the reservation deposit and balance paid will be refunded.

Availability and refund

The availability calendars for all holiday rentals listed on our Website are updated by their Owners or their Representative (Property Managers).  However, it is possible that a situation may arise where a holiday rental booked through our Site may not be available due to circumstances beyond our control, WE cannot be held responsible but   “We” will offer you the option of a full refund of the reservation deposit you paid or will try to find an alternative accommodation with similar quality and price. If we are unable to offer you an alternative accommodation, the reservation will be cancelled, and a full refund of your reservation deposit will be made.

No show

If a Renter (guest) who has made a reservation through our website, does not arrive at the property by  24.00h on the date that they reserved the accommodation for, without any prior notice to the Owner, will be considered a no show. In this situation the owner is not obligated to hold the accommodation anymore. In case of a no show, the accommodation owner must contact “US” (www.bookapartmentcroatia. com/Aurora Novus d.o.o.) in written form and “WE” may approve of a 50% refund of the deposit collected.

The Owner is obligated to issue an invoice to Aurora Novus d.o.o. for the refund.

Minimum stay

Majority of the holiday rentals listed on our Website have a minimum stay required (indicated) in the high season period and it is determined by the Owner.  It is not possible to book them online for less than the minimum required. In this case you can contact us at info@bookapartmentcroatia.com, but please be aware that most owners accept shorter stays at a 20% to 30% higher price.

Maximum Occupancy

Each holiday rental listed on our website indicates the maximum number of persons (adults and/or children/or babies) allowed in each accommodation and it is not possible to be booked online for more persons than is stated in listing. If the number of persons exceeds the stated maximum occupancy upon arrival, the accommodation owner is under no obligation to honor a reservation and may choose to cancel the reservation or allow more persons than the maximum occupancy stated and charge an extra person supplement. In the case that owner chooses to cancel the reservation any deposit paid will be forfeited and should be reported in writing to US.

Arrival information

Once you reservation is confirmed, you will received automated confirmation e-mail from “US”, and you can also print “Confirmation of your reservation” in My account. In both, you will receive all reservation details and Owner’s contact information. You must contact the Owner at least 5 days prior to your arrival regarding key arrangements and to inform him/her of your arrival details. The most common is to meet the owner at the accommodation’s address, where you will be greeted by the owner and given the keys. Please also be aware of check in and check out time.

Holiday Rentals representation

Our website enables Owners using our free tools to make an advert of their holiday rentals and to represent them through internet all over the world for free. Furthermore, owners are able in any time to reflect all changes and upgrades to the accommodations, and to assure that the descriptions and photographs on our website are an accurate representation of the accommodations. Owners, who list their accommodations with us, also have an obligation to have an accurate official document for each listed accommodation. It is a „Rental license” (Rjesenje o kategorizaciji”) issued by Croatian Tourist Authority , which means that each accommodation had meet categorization criteria upon Croatian law of  categorization  + our own criteria, what shows quality or private accommodation. We do our best to assure an accurate representation of all accommodations listed on our website, but cannot be held responsible for any discrepancies, as we are merely a booking agent.

In the event you find that the accommodation you have rented is a materially different than the representation made on our site, please notify us so that we may update our listing and take reasonable steps.

Renter's reponsibilities 

You  (Renter) must keep the accommodation and all furniture, fittings, effects, facilites, equipment and grounds in the same state of repair and condition as at the commencement of your holiday. You will be responsible for any breakages, loss or damage to the accommodation, and Owner reserves the right to ask you to cover the damage. By confirming the reservation, the Renter accepts to pay for all damages caused directly to accommodation owner.

Pets

Pets are not allowed if it is not indicated in the description under Suitability: Pets allowed

Security and valuables

Any valuables left at the property are left at your own risk. Neither Book Apartment Croatia/Aurora Novus d.o.o. nor the property owner is responsible for their loss. No refund can be given should you decide to vacate the property as a consequence of a burglary

Visa requirements

Renter (Guest) is obligated to check before travelling to Croatia whether a visa is necessary, and is absolutely responsible for any inconvenience and possible damage or costs.

Travel Insurance

„BAC“ strongly recommends you purchase travel insurance when booking your holiday rental and  before traveling outside your country.. In the case of a booking cancellation, depending on the reason, you may be able to re-claim this  cancellation under the terms of your insurance policy. Claims must be made directly to the insurance company concerned.

 Behaviour

The party leader (Renter) is responsible fo the correct and decent behaviour of the party. Should you or a memeber of the party not behave in such a manner, the accommodation owner may use their absolute discretion and ask you and the party to vacate the property without refund.

Electronic communications

When you visit www.bookapartmentcroatia.com  or send e-mails to „US“, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Termination

We may, in our sole discretion and without liability to You, with or without cause, with or without prior notice and at any time: terminate Your access to our service, deactivate or delete any of your Accounts and all related information.

Applicable law and jurisdiction

By visiting www.bookapartmentcroatia.com, you agree that the laws of the state of Republic of Croatia, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between You (User) and BAC/ AURORA NOVUS or its associates.

Any controversy, claim or dispute between a user and   BAC/Aurora Novus arising out of or relating to these terms shall be subject to the exclusive jurisdiction of Dubrovnik Court, and each party hereby irrevocably consent to the jurisdiction of such court.
